ORDINANCE NO. 13 -113, FOURTH SERIES CITY OF NEW ULM, BROWN COUNTY, MINNESOTA

AN ORDINANCE AMENDING SECTION 9.04 OF THE CITY CODE OF THE CITY OF NEW ULM RELATIVE TO ZONING IN SAID CITY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:

SECTION I. That the zoning map referenced in subdivision 2 of Section 9.04 of the City Code of the City of New Ulm is hereby amended as follows:

The following- described property, heretofore zoned R-A (Agricultural Residence District), is hereby redesignated and rezoned to R-1 ( Single Family Residence District):

That part of Outlots 126 and 132, in the City of New Ulm, Brown County, Minnesota, described as follows: Beginning at the most southerly corner of Lot 1 of Block Two, FAIRHILLS SECOND ADDITION, according to the recorded plat thereof, also being the most northerly comer of Maplewood Drive, as dedicated per the plat of MAPLEWOOD DRIVE FIRST ADDITION; thence South 55 degrees 31 minutes 11 seconds West bearings based on the Brown County Coordinate System NAD83(07) on the northwesterly line of Maplewood Drive, a distance of 135.00 feet; thence North 34 degrees 28 minutes 49 seconds West, a distance of 772.30 feet; thence North 54 degrees 37 minutes 39 seconds East, a distance of 135.02 feet to the most westerly corner of Lot 10, said Block Two; thence South 34 degrees 28 minutes 49 seconds East on the southwesterly line of said Block Two, a distance of 774.40 feet to the point of beginning. Said block containing 2.40 acres of land.

SECTION II. That the zoning map referenced in subdivision 2 of Section 9.04 of the City Code of the City of New Ulm is hereby amended as follows:

That part of Outlots 126, 127, 131 and 132, in the City of New Ulm, Brown County, Minnesota, described as follows: Commencing at the most southerly corner of Lot 1 of Block Two, FAIRHILLS SECOND ADDITION, according to the recorded plat thereof, also being the most northerly corner of Maplewood Drive, as dedicated per the plat of MAPLEWOOD DRIVE FIRST ADDITION; thence South 55 degrees 31 minutes 11 seconds West bearings based on the Brown County Coordinates NAD83(07) on the northwesterly line of Maplewood Drive, a distance of 195.00 feet to the point of beginning; thence North 34 degrees 28 minutes 49 seconds West, a distance of 771.36 feet; thence South 54 degrees 37 minutes 39 seconds West, a distance of 125.02 feet; thence South 34 degrees 28 minutes 49 seconds East, a distance of 769.42 feet to the northwesterly line of Maplewood Drive; thence North 55 degrees 31 minutes 11 seconds East on said northwesterly line, a distance of 125.00 feet to the point of beginning. Said block containing 2.21 acres of land.

SECTION III. That the zoning map referenced in subdivision 2 of Section 9.04 of the City Code of the City of New Ulm is hereby amended as follows:

The following- described property, heretofore zoned R-A (Agricultural Residence District), is hereby redesignated and rezoned to R-2 ( Single and Two Family Residence District):

That part of Outlots 126 and 127, in the City of New Ulm, Brown County, Minnesota, described as follows: Commencing at the most southerly corner of Lot 1, Block 1, FAIRHILLS FOURTH ADDITION, according to the recorded plat thereof; thence South 55 degrees 31 minutes 11 seconds West bearings based on Brown County Coordinate System NAD83(07) on the northwest line of Birchwood Drive, as dedicated per the plat of FAIRHILLS SECOND ADDITION, a distance of 15.00 feet to the point of beginning; thence continuing South 55 degrees 31 minutes 11 seconds West on said northwest line of Birchwood Drive a distance of 54.97 feet; thence South 54 degrees 37 minutes 39 seconds West, a distance of 246.08 feet; thence North 34 degrees 28 minutes 49 seconds West, a distance of 128.83 feet to the southerly right-of-way line of United States Trunk Highway 14, as per MN/DOT R/W PLAT 08-13; thence North 55 degrees 31 minutes 11 seconds East on said right-of-way line, a distance of 19.51 feet; thence North 34 degrees 28 minutes 49 seconds West on said right-of-way line, a distance of 25.00 feet; thence North 55 degrees 31 minutes 11 seconds East on said right-of-way line, a distance of 155.99 feet; thence South 34 degrees 28 minutes 49 seconds East, a distance of 17.01 feet; thence North 58 degrees 10 minutes 47 seconds East, a distance of 97.12 feet; thence South 79 degrees 28 minutes 49 seconds East, a distance of 37.72 feet; thence South 35 degrees 29 minutes 54 seconds East, a distance of 101.83 feet to the point of beginning. Said Block contains 0.95 acres of land.

SECTION IV. That the City Engineer is hereby ordered to make the necessary alterations to the official map of the City of New Ulm to reflect this change.

SECTION V. That this ordinance shall take effect and shall be in force 30 days from and after its adoption, approval, and publication.
