REZONING REAL
PROPERTY IN THE
CITY OF NEW ULM,
BROWN COUNTY,
MINNESOTA FROM
AGRICULTURE-
OPEN SPACE
(A-OS) TO SINGLE
FAMILY RESIDENCE
(R-1)
BE IT ORDAINED BY
THE CITY COUNCIL
OF THE CITY OF
NEW ULM:
SECTION 1. Upon the
recommendation of the
New Ulm Planning
Commission and pur-
suant to Sections 2.4.B
of Appendix A to the
New Ulm City Code,
and subject to the con-
ditions established in
Section 2 below, the
real property located at
2303 through 2321
North Highland Avenue
in the City of New Ulm,
County of Brown, State
of Minnesota, as legal-
ly described on Exhibit
A hereto, is hereby re-
zoned from
Agricultural-Open
Space (A-OS) to Sin-
gle Family Residence
District (R-1).
SECTION 2. The real
property rezoned ac-
cording to Section 1
and the rezoning of
such real property le-
gally described on Ex-
hibit A shall be condi-
tioned upon each of
the following:
a. That the annexation
of the real property re-
zoned according to
Section 1 into the City
of New Ulm first be ap-
proved by Order of the
State of Minnesota
through its Office of
Administrative Hear-
ings, Municipal Boun-
dary Adjustments Unit;
b. That the petitioner
who has brought the
request for rezoning
shall prepare a plat of
the real property re-
zoned according to
Section 1 that meets
the platting require-
ments of the New Ulm
City Code and is con-
sistent with the legal
description of said real
property attached here-
to as Exhibit A , and
that said plat be ap-
proved by the City
Council; and
c. That the petitioner
shall cause the plat of
the real property re-
zoned according to
Section 1 and ap-
proved by the City
Council pursuant to
subparagraph a of this
Section 2 to be record-
ed in the Office of the
Brown County Record-
er and petitioner shall
pay all applicable
recording fees.
SECTION 3. In the
event that any of the
above conditions are
not met, or in the event
that any of the above
conditions are violated,
the rezoning shall be
null and void.
SECTION 4. The City’s
official zoning map
shall be updated ac-
cordingly.
SECTION 5. This Ordi-
nance shall take effect
and shall be in force
upon thirty (30) days
from and after its adop-
tion, approval, and
publication.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:
SECTION 1. a. That the annexation of the real property rezoned according to Section 1 into the City of New Ulm first be approved by Order of the State of Minnesota through its Office of Administrative Hearings, Municipal Boundary Adjustments Unit;
b. That the petitioner who has brought the request for rezoning shall prepare a plat of the real property rezoned according to Section 1 that meets the platting requirements of the New Ulm City Code and is consistent with the legal description of said real property attached hereto as Exhibit A , and that said plat be approved by the City Council; and
c. That the petitioner shall cause the plat of the real property rezoned according to Section 1 and approved by the City Council pursuant to subparagraph a of this Section 2 to be recorded in the Office of the Brown County Recorder and petitioner shall pay all applicable recording fees.
SECTION 3. In the event that any of the above conditions are not met, or in the event that any of the above conditions are violated, the rezoning shall be null and void.
SECTION 4. The City’s official zoning map shall be updated accordingly.
SECTION 5. This Ordinance shall take effect and shall be in force upon thirty (30) days from and after its adoption, approval, and publication.
